Appeals and Litigation Strategy
At Givens Pursley, we assist clients with complex constitutional, statutory, and regulatory issues. We recognize that some cases may have implications that extend well beyond their facts. Constitutional questions, the validity of agency action, and unsettled areas of state and federal law may impact entire industries. Our lawyers are persuasive writers and skilled oral advocates. They often handle cases with novel legal issues, and we are proud of our record. But we recognize that a lower court’s decision often can be challenged on appeal, so our team of appellate litigators will seek to preserve wins or to reverse any adverse rulings. We will assist with appeals whether Givens Pursley handled the trial court litigation or not. Regardless of the case, we always seek to maximize the chances for appellate success by working cooperatively with trial counsel to advance the best possible legal arguments.
In addition to appellate advocacy, we counsel clients before litigation commences. Our team regularly provides strategic counseling for novel legal issues arising in different contexts. We seek to stay ahead of emerging issues, helping clients navigate changes in federal and state law.
Our team includes former federal and state appellate law clerks who understand how judges approach the law. We help clients analyze, refine, and present concise and compelling arguments to appellate courts across the country, including the Idaho Supreme Court and other state appellate courts as well as the federal circuit courts of appeal and the Supreme Court of the United States. Our team’s experience at the trial and agency level provides a unique perspective to parties in appellate cases, including analysis on the viability of an appeal, framing the issues, and the presentation of written briefs and persuasive oral argument.
Even when our clients are not defending wins on appeal, we can assist with amicus briefs. Our amicus practice empowers clients to present their legal positions as to unsettled issues that affect their interests or industries. Our attorneys have filed amicus briefs in appellate courts at every level of the state and federal judiciary. Our team has the knowledge, skillset, and relationships to efficiently represent clients seeking to maximize the efficacy of amicus briefs.
